Waste Collection Canary Wharf Terms and Conditions

These Terms and Conditions govern the provision of waste collection and related services in and around Canary Wharf. By booking or using our waste collection services, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions and Interpretation

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business, organisation or other entity that requests or uses the waste collection services.

Service means any waste collection, removal, transfer, loading, unloading, or related activity carried out by us for the Customer.

Waste means materials presented by the Customer for collection, including household, commercial, recyclable, bulky or other waste types, subject to applicable regulations and to these Terms and Conditions.

Contract means the agreement between the Customer and the Company for the provision of Services, comprising these Terms and Conditions and any written quotation or confirmation of booking issued by us.

We, us and our refer to the waste collection service provider operating these Terms and Conditions. You and your refer to the Customer.

2. Scope of Services

We provide scheduled and one-off waste collection services within the Canary Wharf area and surrounding locations, subject to operational capacity and applicable laws. The exact nature of the Service, including collection date, time window, type and volume of Waste, and any additional services, will be agreed at the time of booking.

We reserve the right to refuse or amend any Service request that is unsafe, unlawful, impractical, exceeds vehicle capacity, or falls outside our standard operating procedures. Where possible, we will discuss alternative arrangements with you.

3. Booking Process

Bookings can be made by telephone, email, online form or other communication methods we make available from time to time. When making a booking, you must provide accurate and complete information, including:

Full name or business name.

Collection address and access details.

Contact details for the person responsible on the day of collection.

Type, approximate quantity, and description of the Waste to be collected.

Preferred date and time window for collection.

Any special access instructions, parking requirements or site restrictions.

Your booking is not confirmed until we issue a booking confirmation, which may be provided verbally, by email, or in writing. By confirming the booking, you warrant that the Waste is as described and that you have full authority to arrange its removal.

We may issue a quotation based on the information you provide. If, upon arrival, the actual Waste type or quantity materially differs from that described at booking, we may adjust the price, modify the Service, or decline to proceed, as set out in these Terms and Conditions.

4. Access and Customer Responsibilities

You are responsible for ensuring safe, lawful and reasonable access to the collection point at the agreed time. This includes arranging any necessary permissions for parking, loading or temporary stopping of our vehicles.

You must ensure that:

The Waste is at the agreed location, clearly presented and ready for collection at the scheduled time.

The area is safe for our operatives, free from hazards such as loose debris, unsafe structures or aggressive animals.

Any required keys, access codes, permits or security instructions are provided in advance or on arrival.

If we are unable to access the collection point, or if the site conditions are unsafe, we may at our discretion either wait for a reasonable period while you remedy the issue, reschedule the Service, or treat the booking as a missed collection. Additional charges may apply in such circumstances.

5. Waste Types and Regulations

All Waste must comply with applicable UK waste management laws and regulations, including but not limited to the Environmental Protection Act 1990 and the duty of care requirements for waste transfer. You are responsible for ensuring that any Waste you ask us to collect is lawful to handle and transport.

We do not accept certain hazardous or prohibited items unless explicitly agreed in advance and arranged under specific conditions. Examples include, but are not limited to:

Chemicals, solvents and corrosive substances.

Asbestos or materials containing asbestos.

Clinical, medical or biological waste.

Gas cylinders and pressurised containers.

Explosives, firearms or ammunition.

Radioactive materials.

If hazardous or prohibited Waste is discovered during collection, we may refuse to remove it, suspend the Service, or arrange specialist handling at additional cost, subject to your approval. If you incorrectly describe hazardous or prohibited Waste as non-hazardous, you may be liable for any costs, losses or regulatory penalties we incur as a result.

Where required by law, a waste transfer note or similar documentation will be completed for each collection. You agree to provide accurate information for these documents and to retain your copy for the legally required period.

6. Pricing and Payment Terms

Our charges are based on factors such as the type and approximate volume or weight of Waste, the nature of the site, access conditions, labour required, and the disposal or recycling methods applicable. We may provide a quotation in advance or confirm the final price on site before commencing the Service.

Unless otherwise agreed, all prices are quoted in pounds sterling and may be subject to value added tax at the prevailing rate. Any quoted price is valid only for the period stated, or if no period is stated, for a reasonable time, and may be withdrawn or varied prior to acceptance.

Payment is due in accordance with the terms agreed at booking, which may include:

Immediate payment on completion of the collection.

Advance payment at the time of booking.

Payment on invoice within an agreed number of days for approved account customers.

We accept the payment methods stated at the time of booking. If payment is not received when due, we reserve the right to charge interest on overdue sums, suspend or cancel future Services, and recover any costs incurred in enforcing payment.

7. Variations and Additional Charges

If, upon arrival at the site, we find that:

The volume or weight of Waste is significantly greater than described.

The type of Waste differs materially from that stated.

Access is more difficult or labour-intensive than anticipated.

Additional services are requested, such as dismantling, extra loading time or multiple trips.

we may adjust the price to reflect the actual Service required. We will inform you of any additional charges before proceeding wherever reasonably possible. If you do not agree to the revised price, we may decline to carry out the Service, in which case a call-out fee or cancellation charge may apply.

8. Cancellations and Rescheduling

You may cancel or reschedule a booking by contacting us using the details provided in your booking confirmation. The following terms will normally apply unless otherwise stated in writing:

If you cancel or reschedule more than 24 hours before the scheduled collection time, no cancellation fee will usually be charged.

If you cancel or reschedule within 24 hours of the scheduled collection time, we may charge a cancellation fee to cover administrative and operational costs.

If our team attends the site at the agreed time but is unable to carry out the Service due to reasons within your control, including lack of access, unprepared Waste, or incorrect booking details, this may be treated as a missed collection and a call-out or cancellation fee may apply.

We may cancel or reschedule a booking where necessary due to vehicle breakdown, staff illness, extreme weather, safety concerns, regulatory issues or other circumstances beyond our reasonable control. In such cases, we will endeavour to notify you as soon as practicable and offer a new collection time. We will not be liable for any loss arising from such cancellations or delays, subject to the liability provisions below.

9. Service Performance and Time Windows

We will use reasonable endeavours to provide the Service on the agreed date and within any quoted time window. However, all dates and times are estimates and are not guaranteed unless expressly stated otherwise in writing.

Factors such as traffic, parking availability, access issues, weather and operational constraints may affect our arrival time. You agree to allow reasonable flexibility in the time of arrival. If we anticipate a significant delay, we will attempt to contact you using the details you provided at booking.

10. Title, Risk and Disposal

Once the Waste has been loaded onto our vehicle and any required documentation has been completed, title and risk in the Waste will normally pass to us, except where otherwise required by law. We will transport and dispose of or recycle the Waste through appropriately licensed facilities, in accordance with applicable regulations and our own environmental policies.

We may, where legally permitted and environmentally suitable, segregate and recover materials for reuse or recycling. You agree that we are not obliged to return any Waste or items once collected, unless required by law or agreed in writing.

11. Liability and Limitations

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability cannot lawfully be excluded or limited.

Subject to the preceding paragraph, our liability to you arising out of or in connection with the Contract, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall be limited as follows:

We shall not be liable for any loss of profits, loss of business, loss of opportunity, loss of anticipated savings, or any indirect or consequential loss or damage.

Our total aggregate liability in respect of any claim or series of claims arising from the same event or circumstances shall not exceed the total price paid or payable by you for the specific Service giving rise to the claim.

You are responsible for removing or securing any items you do not wish us to take. We will exercise reasonable care when carrying out the Service, but we shall not be liable for minor damage to driveways, surfaces, access routes or surrounding areas arising from the normal operation of vehicles or the handling of Waste, provided we act with reasonable skill and care and follow your instructions.

If you believe we have caused damage or loss, you must notify us in writing as soon as reasonably practicable and, in any event, within a reasonable period after becoming aware of the issue, providing full details and supporting evidence where available. Failure to do so may affect our ability to investigate and resolve the matter.

12. Customer Indemnity

You agree to indemnify and hold us harmless against any claims, losses, damages, costs and expenses including reasonable legal fees arising from:

Your breach of these Terms and Conditions.

Your failure to comply with applicable waste regulations or duty of care obligations.

Incorrect or incomplete description of the Waste, including any hazardous or prohibited items.

Any third-party claim relating to Waste or property that you did not have authority to present for collection.

13. Data Protection and Privacy

We will collect and use personal data you provide to manage your booking, deliver the Service, process payments, and handle any queries or complaints. We will store and process your personal data in accordance with applicable data protection laws. By using our Services, you consent to the processing of your personal information for these purposes.

We may contact you using your provided details regarding your booking, operational updates, or relevant service information. You may request access to, or correction of, your personal data by contacting us using the details supplied in your booking confirmation or invoice.

14. Changes to These Terms and Conditions

We may update or amend these Terms and Conditions from time to time. The version in force at the time you make a booking will apply to that Contract. Any updated terms will be made available upon request and may be published on our standard communication channels.

15. Severability

If any provision of these Terms and Conditions is held by a court or competent authority to be invalid, unlawful or unenforceable, such provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, whether contractual or non-contractual, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the Contract, or the provision of the Services.

17. Entire Agreement

These Terms and Conditions, together with any written quotation or booking confirmation issued by us, constitute the entire agreement between you and us in relation to the provision of the Services and supersede any prior understandings, representations or agreements, whether oral or written.

By confirming a booking or presenting Waste for collection, you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions.
